What Does It Mean When IRS Assesses You for Certain Tax Years and Who Can Help You
By: Cassandra Ingraham
Many times IRS will access a Taxpayer for years that the taxpayer did not file a tax return. This is because IRS received W-2 information or 1099 information form a Contractor or Employer. If IRS has accessed you - that just means they have done your tax return for you!
When IRS completes a tax return for you - it is almost always in their favor! You come out owing more taxes then if you had filed your own tax return. AND after IRS has added the penalties and interest the tax bill can double.
The upside is that an Unenrolled Agent (and I use the word 'agent' sparingly) can legally help you - and the cost is usually reasonable. They are registered with IRS, have ID numbers and are held accountable. However, there is a downside.
The downside is Unenrolled Agents cannot 'speak' for you when they call IRS. They have the legal ability to obtain information from IRS on your behalf (with some restrictions) - and file the correct form - yet they cannot speak for you or represent you before IRS. For this reason their fees for service are much less then an Enrolled Agent, Tax Attorney or a CPA.
If your Tax professional is not open year round and cannot be found after Tax season - and the IRS notice says "audit" then it is time to hire an Enrolled Agent, Tax Attorney or CPA. These individuals are expensive - yet it could cost you more to start dealing with IRS on you own.
IRS is driven by Forms; the correct form filled out correctly will change your status with IRS within moments. Most competent Tax Practitioners know and understand this. Sometimes it is only a matter of providing additional information to IRS or amending the tax return.
Taxpayers who insist on dealing with IRS themselves can sometimes run into trouble and not even know they are in trouble. It is a felony to lie to and IRS Agent. Yet sometimes when you tell the whole truth (even when they did not ask you - you just volunteer the information) you can end up paying a lot more each month then if you had called your tax professional.
